GENERAL TERMS AND CONDITIONS FOR EXPEDITION FOR TRUCKS

Expedition For Trucks is part of Expedition Far East BV.

These terms and conditions apply to Expedition For Trucks group trips; ‘educational and individual guided adventurous overland trips’, to inform (potential) participants about their rights and obligations when traveling with a camper, expedition vehicle, or a 4×4 expedition vehicle. Additionally, information is provided about what you can expect on your trip.

  1. TERMS OF PARTICIPATION EXPEDITION FOR TRUCKS TRAVELS
    1.1 Participants are expected to be capable of completing the planned trip based on their physical and mental condition (without assistance from others). Except under special circumstances, participants are also expected to attend the entire group trip; registration for part of the group trip is therefore not possible.
    1.2 Participants with a physical or mental disability or chronic illness must ensure that their participation does not impose a burden on themselves or the group. Registration always occurs in consultation with Expedition For Trucks. The trips offered by Expedition For Trucks are not suitable for participants who use aids such as walkers, mobility scooters, or wheelchairs, due to the destinations and the adventurous nature of the journey. In case of any doubt, prospective participants should consult Expedition For Trucks before booking, and additional arrangements may be made with the participant. If Expedition For Trucks, possibly in consultation with the trip leader, issues a negative recommendation, Expedition For Trucks reserves the right to exclude the participant from taking part. If it appears that participation in (part of) the trip is not possible due to a physical and/or mental limitation, the trip leader, in consultation with the affected individuals and/or the management of Expedition For Trucks, can take appropriate measures. This may result in (further) participation in the trip being denied, and in potential exclusion from future Expedition For Trucks trips.
    1.3 It is recommended to bring personal medical information prepared in a language usable in the countries to be visited. Translations can take a lot of time, so be mindful of the departure date. An international medical passport with personal information can be requested from a general practitioner or pharmacy. The participant remains responsible for the consequences of the decision to participate in the trip.
    1.4 If participants are following a special diet, they should indicate this at the time of registration. However, the trip leadership cannot be held responsible for the correct adherence to dietary requirements by external suppliers (including restaurants).
    1.5 Participants must ensure that registration for a trip is also suitable for their vehicle (registered as such and as described in Dutch law (Regulation on Vehicles)). Limitations for the participation of certain travel vehicles will be specified for each trip separately. This is due to sometimes limited opportunities for certain travel vehicles. One of the participants must possess a valid driver’s license.
    1.6 Participants must independently verify whether health advice (such as preventive measures to avoid diseases and vaccinations) applies for the destination(s) and any activities. Your general practitioner, the Ministry of Health, or the National Coordination Centre for Travel Advice can provide you with more information.
    1.7 Expedition For Trucks reserves the right to make changes to the published itinerary at any time, both before and during the trip. They will implement these changes if unforeseen circumstances (including safety issues) necessitate them or if the changes are deemed to enhance the travel program according to Expedition For Trucks.
    1.8 Anyone who voluntarily chooses a different route or overnight accommodation than indicated by the travel guidance and/or travel book is leaving the trip. This also applies to teams that voluntarily decline to participation in the ‘mandatory’ briefings, which are designated on-site by the travel guidance regarding location and timing. The responsibility and liability of the travel guidance and the organizer of the trip are waived during this time and are limited to minimal support; the travel guide will never be personally present for assistance. It is also the responsibility of the traveller to rejoin the group on time. If the traveller does not join the group at the previously agreed time, it is their own responsibility, and no refund of the travel sum will be given. Additionally, no claims can be made on the travel guidance in case of breakdown, accident, or illness, and one is entirely reliant on themselves.
  1. INFORMATION
    2.1 The registrant is jointly liable for all obligations arising from the registration. All communication and payment transactions between the participant(s) on one side and Expedition For Trucks on the other will solely be conducted through the registrant.
    2.2 The participant(s) must provide Expedition For Trucks with all relevant information about themselves, the registered participants, and the travel vehicle at the time of registration, which may be important for booking various components and executing the trip. This information also includes details concerning the status of the registered individuals. It explicitly refers to the need to specify any physical and/or psychological limitations as concretely as possible. This is all in accordance with the questionnaire on the registration form signed by the traveller(s). Regarding minor participants on a trip with Expedition For Trucks, the registrant must demonstrate that, unless they are the parents or guardians themselves, the parents/guardians/caregivers of the minor in question have given their consent to participate in the trip. For the vehicle, the length of the vehicle, including any bike rack, as well as its height and weight, must be provided. Changes to information can be communicated without amendment costs up to six weeks before departure; however, the associated (sometimes high) costs from suppliers (such as a ferry or airline) will be charged to the registrant. Additionally, there will be amendment costs of €25 per change for alterations made within six weeks before departure.
    2.3 The participant is responsible for obtaining the correct travel documents, such as a visa, passport, driver’s license, insurance card, and proof of vaccination. Also, check that your passport or identity card is valid for long enough. If you do not possess (solely) Dutch identity, Expedition For Trucks advises you to contact your own embassy or the embassy of your travel destination to obtain information about the required travel documents. For accompanying children, it may be necessary for the non-traveling parent to give consent for the trip.
    2.4 If the participant(s) does/do not comply with the preceding sections 2 and 3, any related consequences will be at their own expense. No claims can be made for support from the travel assistance. Furthermore, these participant(s) may be excluded from (further) participation in the trip, and any costs arising from this will be charged to them. Expedition For Trucks cannot be held liable in this regard.
    2.5 During the preparation period, information (in writing, by mail) will be provided by Expedition For Trucks. When this is no longer possible due to the remaining time before departure, it will be taken over by the trip leader. For this, it is necessary that the phone numbers of all participants in the trip are known to the organization. Expedition For Trucks will provide information regarding passports, visas, and any formalities related to health or transportation to the traveller at most 3 months before the start of the trip, but at the latest during the preparation and participant day(s) for the respective trip.
    2.6 All participants must be reachable during a trip for the trip leaders at the mobile phone number as filled in on the registration form. In addition, all participants must be reachable, in each country visited separately, at a mobile phone number of the respective country and also via WhatsApp, by purchasing a SIM card in each country visited separately and ensuring it is always adequately topped up with the required credit. In case of emergencies or other special circumstances, the trip leader will be able to contact the participant(s) via these phone number(s) and/or WhatsApp.
    2.7 In the execution of the trip, third parties/suppliers are involved. The participant grants permission for the sharing of the aforementioned data necessary for the execution of the trip. Expedition For Trucks and the trip leader are authorized to use and share participant data with campsites, ferry companies, and other involved parties, provided this is functional and in compliance with the GDPR (General Data Protection Regulation). This also includes the creation of a WhatsApp group by the trip leader with all participants for sharing travel-related information.
    2.8 Expedition For Trucks trips, as published on its website, third-party websites, and any other online or physical expressions, offered in collaboration with other (travel) organizations, companies, and/or associations, are always carried out by Expedition For Trucks. Bookings and payments are made without the involvement of the third party and are done directly with/to Expedition For Trucks. The role of the third party in this case is limited to a referral. The participant enters into a direct agreement with Expedition For Trucks. A third party is never part of the agreement between the participant and Expedition For Trucks. A third party is never responsible for the procurement and delivery/execution thereof, and the General Terms and Conditions of Expedition For Trucks are always exclusively applicable and never the General Terms and Conditions of a third party. After registration through a third party, all further contact therefore takes place directly between the participant and Expedition For Trucks.
    2.9 The participant(s) must hold the necessary documents for the relevant destination upon departure and during the trip, such as a valid passport, a second passport if required, any necessary visas, proof of vaccinations, national and international driving licenses, national registration certificates, an insurance card listing all countries to be visited, and a declaration from your insurance company that your vehicle is insured in all countries visited during this trip. Given the great importance of this matter, the traveller must verify the applicability, completeness, and current status of the general information provided by Expedition For Trucks with the relevant institutions and authorities.
    2.10 If the participant(s) cannot complete the trip (entirely) due to the absence of any (valid) document or explicitly required information for the trip indicated by Expedition For Trucks, such as necessary vehicle information, they will bear all associated consequences and costs.
  1. OFFERS
    3.1 All offers from Expedition For Trucks are entirely non-binding and serve only as an invitation to enter into an agreement. The mere issuance of a price quote, whether or not indicated with an offer, proposal, estimate, preliminary calculation, or similar communication in advertisements or on the internet does not obligate Expedition For Trucks to conclude an agreement with the participant.
    3.2 Offers intended as advertising messages, reviews, and customer evaluations on our websites and in third-party publications are not part of the content of the agreement between the parties.
    3.3 Expedition For Trucks is not liable for any (printing) errors in the listed prices or descriptions of trips about which they inform potential participants. Expedition For Trucks reserves the right to withdraw an offer.
  1. BOOKING – NUMBER OF PARTICIPANTS – WAITING LIST
    4.1 In case of (printing) errors, and for other compelling reasons, Expedition For Trucks is entitled to reject a booking. In that situation, no agreement will be established.
    4.2 Expedition For Trucks is entitled to grant a participant, for its compelling reasons, a priority position in the booking process.
    4.3 Expedition For Trucks is entitled to reject and/or cancel a participant before the start of the trip for its compelling reasons and without further explanation.
    4.4 The minimum and maximum number of teams/participants is determined per trip. Registrations exceeding the maximum will be noted as ‘reserve’. The relevant registrant will be notified as soon as possible. Expedition For Trucks reserves the right to accept 2 overbookings per trip. This number usually corresponds to the average cancellation rate. Should one or more teams unexpectedly participate, and this only becomes clear to participants at the starting point of a trip, there will be no grounds for cancellation or refund of the travel amount or any part of it.
    4.5 If the minimum number of participants is not reached six weeks before the start, Expedition For Trucks reserves the right to cancel the trip, and the deposit will be refunded.
    4.6 Registration on the waiting list is possible. If a spot becomes available at any time due to circumstances, an opportunity may be offered to participate in the trip. When the booking is confirmed by means of the booking confirmation, the placement is final.
    4.7 The position on the waiting list is primarily determined by the order of registration. Placement on the waiting list is free of charge and non-binding.
  1. AGREEMENT – BOOKING CONFIRMATION
    5.1 The contract is established by the acceptance of the offer from the travel organizer by the traveller. The acceptance may occur either directly or through the mediation of third parties.
    5.2 The booking becomes definitive once it is confirmed in writing or electronically by Expedition For Trucks in the form of a booking confirmation, possibly accompanied by an invoice, or when Expedition For Trucks has commenced its services.
    5.3 Every accepted booking is confirmed in writing or electronically by Expedition For Trucks to the participant. The booking confirmation includes the (link to the) content of the agreement between the participant(s) and Expedition For Trucks.
    5.4 Expedition For Trucks shall execute the agreement to the best of its knowledge and ability in accordance with the provisions of the agreement. The agreement involves a commitment to make efforts on the part of Expedition For Trucks.
  1. FARES – PROGRAM
    6.1 By making a booking, the participant(s) are required to pay the travel sum.
    6.2 The published travel sum is based on the prices, exchange rates, charges, and taxes that were known to the travel organizer at the time of publication.
    6.3 The published travel sum applies per person based on participation by 2 people per vehicle, unless stated otherwise. It includes the services and facilities as mentioned in the publications and on the website.
    6.4 The travel duration is usually stated in full days. The days of departure and arrival are included, regardless of the departure and arrival times. This could mean that your stay at the destination is shorter than the stated travel duration. This does not give rise to a claim for a refund of any (part of the) travel sum. If the trip is shorter due to circumstances beyond Expedition For Trucks’s control, no refund will be issued; conversely, if the trip is longer, no additional payment is required.
    6.5 Expedition For Trucks is authorized, after the agreement is established, to implement price increases up to a maximum of 14 days before the departure of the trip if there are circumstances that increase the cost of the trip, even if the travel sum has already been paid. If Expedition For Trucks finds it necessary to raise the costs of a trip, the participant has the right to cancel the trip if this increase exceeds 15% of the travel sum. In that case, the participant has the right to cancel the trip free of charge. Cancellation must take place within 3 working days after receiving the notification of the increase, after which a refund of the paid travel sum will occur. However, this rule does not apply to airline tickets, cruise costs, ferry costs, fuel surcharges, and (air)port taxes. Prices for these, as mentioned in the publication, are indicative. Cancellations following the announcement of the final costs for these will therefore be handled according to articles 13.2 and 13.3 of these conditions.
    6.6 No refund of the travel amount will be granted for activities, dinner, and/or overnight stays that are not fully or partially participated in.
    6.7 If a participant voluntarily refrains from further participation during a trip and/or does not wish or cannot travel to the endpoint of a trip, or for example voluntarily opts out of a pre-booked ferry crossing, there will never be a refund or compensation for the days not participated in and/or ferry costs. If there are any additional costs incurred by Expedition For Trucks due to the aforementioned, these costs will be borne by the participant.
    6.8 Considering the individual nature of the trips organized by Expedition For Trucks, there is no written program, and only the Expedition For Trucks roadbookÓ , serves as the sole guideline for the (route) progression of the trip.
  1. DOWN PAYMENT – PAYMENT TRAVEL AMOUNT
    7.1 A deposit of 15% of the total agreed travel amount must be paid at the time of entering into the agreement. Upon receipt of the deposit, the booking becomes final. The remaining travel amount, 85% plus any additional fees and costs not included in the travel amount, must be paid no later than 3 months before the departure date. If payment is not made on time, the traveller is in default.
    7.2 If registering within 3 months of the departure date, the full travel amount must be paid immediately.
    7.3 Late or non-payment may result in removal from the participant list. In that case, cancellation fees will be charged according to the provisions in articles 13.2 and 13.3.
    7.4 If payment obligations are not met, Expedition For Trucks will engage a collection agency after two reminders. The ensuing costs will be borne by the defaulting party, and this party will be excluded from future participation in Expedition For Trucks trips.
  1. TECHNICAL STATE OF TRANSPORT VEHICLE – PROVISIONS
    8.1 Participants are expected to ensure that their travel vehicle is in perfect (technical) condition and complies with the legal requirements of the countries they are traveling through. Also, participants are expected to have their travel vehicle offered for a thorough inspection at a dealer or garage prior to departure.
    8.2 A valid insurance card must be issued for the participating travel vehicle.
    8.3 Expedition For Trucks will verify during the preparation and/or participant day(s) that each participating team has all the mandated (spare) parts and other items on hand.
    8.4 The travel vehicles must be equipped in such a way that they can travel and stay for several days without a land power connection. A refrigerator, shower, and basic sanitary facilities must be available.
    8.5 Restrictions on the participation of travel vehicles with a certain size will be mentioned separately for each trip. This is due to the limited possibilities for large vehicles. For travel vehicles longer than indicated, contact must be made with Expedition For Trucks prior to booking to verify whether the trip is suitable for this travel vehicle. The length of the travel vehicle must be stated including any bike rack and/or trailer.
  1. RELATIONSHIP TO THE TRIP LEADER(S) – PARTICIPANTS.
    9.1 Participants are expected to have mutual respect for one another, value each individual, possess good adaptability, maintain a flexible and positive attitude, and have the ability to think in terms of solutions rather than problems, in order to contribute to the success of the individually guided adventurous overland trip. Although Expedition For Trucks is not responsible for the behaviour of other participant(s), the trip leader may address a participant regarding (noise) disturbances and take appropriate measures, due to the importance of the group trip.
    9.2 The trip leadership on Expedition For Trucks journeys typically consists of 1 or 2 trip leaders. The trip leader is a person appointed by Expedition For Trucks, along with their partner, who takes on the responsibility of organizing and/or leading a trip. Cooperation from all participants is required. The trip leader is authorized, if necessary, in consultation with Expedition For Trucks management, to take measures on-site that they deem necessary for the continuation of the trip and the well-being of the participants in case of problems.
    9.3 If the trip supervision fails (temporarily) for any reason, Expedition For Trucks reserves the right to find one of the participating teams to temporarily take over, as there may be no replacement supervision on-site, or if sending replacement supervisors is no longer feasible given the remaining duration of the trip or the remaining stay in a country. This will be done with full and intensive support from the management of Expedition For Trucks from a distance. Expedition For Trucks is committed to ensuring that replacement trip supervision joins the group as soon as possible and will do everything in its power to make this realistically achievable and meaningful.
    9.4 The trip supervision is not authorized to act as a substitute driver for a participant. Should a trip supervisor act in relation to a participant’s vehicle at the participant’s request, it is at the participant’s own risk and expense. Expedition For Trucks accepts no liability in this regard.
    9.5 If the execution of a trip gives rise to a complaint, the participating traveller must report this as soon as possible – on-site – to the tour guide, so that a suitable solution can be found. If a complaint is not satisfactorily resolved, a complaint report must be drawn up on-site, which must be signed by the participant and the tour guide. This complaint report must be submitted to Expedition For Trucks, Steenstraat 122a 5831 JJ Boxmeer, Netherlands, no later than 14 days after the end of the trip or the service received. If no complaint report is drawn up on-site, the complaint is considered to have been resolved satisfactorily. In that case, any liability of Expedition For Trucks is excluded.
    9.6 If a participant’s behaviour gives rise to one or more complaints, the tour leader will discuss the complaint with the participant concerned. If a complaint is not satisfactorily resolved, a complaint report must be drawn up, to be signed by the complaining participant(s) and the tour leader. If the misconduct of the concerned member is so serious that the other participants or the tour leader believe that further participation of this member in the trip is undesirable, or if this participant causes such disturbance or burden that it significantly hampers the execution of the trip, or endangers the other participants or the organization, he/she may be excluded from further participation in the trip by the tour leader. In such a case, the removed member cannot claim any compensation or partial refund of the trip amount. To the extent that the consequences of the disturbance and burden can be attributed to this traveller, all resulting costs will be at his/her expense. The complaint report must be submitted to Expedition For Trucks, Steenstraat 122a 5831 JJ Boxmeer, Netherlands, no later than one month after the end of the trip.
    9.7 The traveller is obliged to follow all instructions for the promotion of a successful travel execution from Expedition For Trucks and the travel guides. The traveller is liable for damages caused by non-compliance with this obligation.
  1. INSURANCE
    10.1 Expedition For Trucks strongly advises participants to take out good insurance, such as a (camper) vehicle insurance (at least liability with passenger coverage), breakdown assistance coverage with replacement transport, and repatriation from abroad (with the exception of countries outside the insurance card), health insurance, accident, travel (baggage) insurance, and cancellation insurance. Your specific situation determines the necessity or desirability of taking out the relevant insurance and coverage. It is the participant’s own responsibility to obtain the necessary insurance. Expedition For Trucks can never be held liable if a participant chooses not to take out insurance.
    10.2 Taking out cancellation insurance is highly recommended. This must be done within 7 working days after receiving the booking confirmation by the participant(s). If it turns out during the trip or afterward that the participant has not fulfilled their obligations under this article, Expedition Trucks shall not be liable in any way for any damages suffered by the participant as a result of insufficient insurance coverage.
    10.3 If a liability insurance is required in the countries visited by participants during a trip, and this cannot be arranged in advance or directly at the border, Expedition For Trucks can never be held liable for this. Driving without insurance is at all times solely at the risk of the participant(s).
  1. PETS
    11.1 Pets can only be allowed on Expedition For Trucks trips after consultation with Expedition For Trucks prior to registration. However, this does not necessarily mean that the trip is suitable for every pet. The participant must independently research whether the trip is suitable for a pet before registration. There may be trips where pets are not allowed at all, due to the country, destination, climate, and/or nature of the trip.
    11.2 All additional costs for pets are the responsibility of the participant/owner. These will be charged as a surcharge if known in advance. Costs incurred during the trip must be paid by the participant/owner on-site; these costs are not included in the travel sum.
    11.3 The participant must take into account that the pet may not be welcome in public spaces and/or public transport. Expedition For Trucks points out that pets are not allowed under any circumstances on excursions or during group meals and briefings; no exceptions will be made. During trips, occasional overnight stays may take place at a campsite, camper location, or hotel with (limited) facilities, as well as in the wild or at a parking lot with no facilities. As a result, the air conditioning may not function (sufficiently), meaning the pet cannot remain in the vehicle. The care for the pet is the responsibility of the participant.
    11.4 Often, a ‘European pet passport’ is required, which includes vaccination certificates (for example, against rabies). In some countries, stricter requirements apply. Therefore, check in advance with the embassy of the destination country for the exact admission requirements.
    11.5 Accompanying pets must always be on a leash outside the vehicle, as well as at overnight stays in the wild.
    11.6 If the pet causes disturbances, even if experienced as such by another participant, the participant/owner may be addressed by the travel guidance and asked to take appropriate measures, such as leashing or using a muzzle, etc. In case of disturbances, the participant will be addressed by the travel guidance and must comply with the request at all times. If the disturbances warrant further action, it will be handled according to the provisions in article 9.6.
  1. STAY LOCATION – ACCOMMODATIONS, FACILITIES – ACTIVITIES
    12.1. Expedition For Trucks describes the accommodation/overnight location as objectively as possible. Participants should keep in mind that maintenance work may occasionally occur around the accommodation/overnight locations. This may result in the temporary unavailability of a facility (such as water supply, toilet, showers, etc.) or may cause inconvenience. When there is disruption due to construction activities, Expedition For Trucks will try to inform you in a timely manner and provide an appropriate solution. Unfortunately, it may happen that the travel guides on-site encounters construction work of which Expedition For Trucks was also unaware. Therefore, some inconvenience due to construction activities cannot be excluded. Any photos only provide an impression of the layout, dimensions, and/or view of the accommodation/overnight location. The actual situation may differ from the photos. Expedition For Trucks is not responsible or liable for any of this and asks for your understanding.
    12.2 Accommodation locations/overnight places in the countries included in the trips of Expedition For Trucks often do not take the necessary measures to combat infectious diseases (think of legionella). Therefore, Expedition For Trucks advises you to also take necessary actions to minimize the risk of infection as much as possible.
    12.3 Any locally bookable activities or services such as excursions, tours, events, visits, and sports are offered outside the influence of Expedition For Trucks. Expedition For Trucks publishes information about these and only mediates as a service consideration. Participation in an activity is optional and does not need to be communicated in advance by a participant. If a participant(s) is/are not present at the agreed time, this automatically indicates a desire not to participate. As a service consideration, it may be that the tour guide collects entrance fees and pays them on your behalf for the activity or service. However, the final agreement for the execution of the activities and services is established between the participant and the local supplier/organization of those services. Expedition For Trucks is not a party in this matter. Expedition For Trucks points out that the supplier/organizer is responsible and liable for the execution of those activities and services. Expedition For Trucks accepts no liability for damages arising during participation in an activity and/or service booked locally.
    12.4 The participant must be well informed before deciding to participate in an activity. Expedition For Trucks points out that for some activities, additional (travel) insurance may be desirable. The participant must also be aware of the consequence of being unable to continue participating in the trip after sustaining injury from taking part in certain activities.
    12.5 No refund will be granted for the travel sum for activities that are either not participated in at all or partially.
    12.6 It is possible that you may be asked for a deposit at a location or activity. This may occur through cash or by leaving a passport or bank card. Remember to request a refund of the deposit. Expedition For Trucks cannot be held liable for wrongfully withholding all or part of the deposit, nor for the situation where you forgot to request your deposit back.
  1. CANCELLATION OF THE TRIP BY THE REGISTRANT
    13.1 The participant can terminate/cancel the travel agreement with immediate effect but will be required to compensate Expedition For Trucks for any damages incurred as a result.
    13.2 If the participant cancels the trip after receiving the booking confirmation for educational travels Expedition For Trucks will charge the following amounts to cover the costs incurred:
    – In case of cancellation up to the 270th day (exclusive) before the departure day: 15% of the travel sum.
    – In case of cancellation from the 269th day (inclusive) to the 180th day (exclusive) before the departure day: 40% of the travel sum.
    – In case of cancellation from the 179th day (inclusive) to the 120th day (exclusive) before the departure day: 70% of the travel sum.
    – In case of cancellation from the 119th day (inclusive) to the 115th day (exclusive) before the departure day: 90% of the travel sum.
    – In case of cancellation from the 14th day (inclusive) before the departure day: the full travel sum.
    13.3 If the registrant cancels the trip after receiving the booking confirmation for travels up to 50 days (exclusive), Expedition For Trucks will charge the following amounts to cover the costs it has incurred:
    – For cancellations up to the 159th day (exclusive) before the departure day: 15% of the travel sum.
    – For cancellations from the 159th day (inclusive) to the 75th day (exclusive) before the departure day: 40% of the travel sum.
    – For cancellations from the 75th day (inclusive) to the 45th day (exclusive) before the departure day: 70% of the travel sum.
    – For cancellations from the 45th day (inclusive) to the 14th day (exclusive) before the departure day: 90% of the travel sum.
    – For cancellations from the 14th day (inclusive) before the departure day: the full travel sum.
    13.4 If the subscriber cancels the trip after receiving the booking confirmation for travels starting from 50 till 89 days (inclusive), Expedition For Trucks will charge the following amounts to cover the costs incurred by it:
    – For cancellations up to the 269th day (exclusive) before the departure day: 15% of the travel sum.  – For cancellations from the 269th (inclusive) to the 179th (exclusive) before the departure day: 40% of the travel sum.
    – For cancellations from the 179th (inclusive) to the 119th (exclusive) before the departure day: 70% of the travel sum.
    – For cancellations from the 119th (inclusive) to the 14th (exclusive) before the departure day: 90% of the travel sum.
    – For cancellations from the 14th day (inclusive) before the departure day: the full travel sum.
    13.5 If the applicant cancels the trip after receiving the booking confirmation for travels starting from 90 days (inclusive), Expedition For Trucks will charge the following amounts to cover the costs incurred by them:
    – In case of cancellation up to the 365th day (exclusive) before the departure date: 15% of the travel sum.
    – In case of cancellation from the 365th (inclusive) to the 269th (exclusive) day before the departure date: 40% of the travel sum.
    – In case of cancellation from the 269th (inclusive) to the 179th (exclusive) day before the departure date: 70% of the travel sum.
    – In case of cancellation from the 179th (inclusive) to the 90th (exclusive) day before the departure date: 90% of the travel sum.
    – In case of cancellation from the 90th day (inclusive) before the departure date: the full travel sum.
    13.6 If the transport is carried out by plane or special services such as ferry crossings, vehicle rentals, national parks, and cultural or sports events are offered, different cancellation regulations from the respective supplier may apply to that transport or those special services. These provisions are also applicable.
    13.7 Already prepaid costs by Expedition For Trucks for receiving the cancellation such as invitation letters, visa fees, etc., will be charged in addition to the cancellation fees mentioned in sections 13.2, 13.3 13.4 and 13.5.
    13.8 Cancellation of the travel agreement by the registrant must be carried out in writing or electronically. Cancellations outside of opening hours (Mon-Fri from 10:00 AM – 5:00 PM) will be deemed to be made on the next business day thereafter.
  1. CANCELLATION OF THE TRIP BY EXPEDITION FOR TRUCKS – PROGRAM CHANGES
    14.1 Expedition For Trucks has the right to terminate the agreement if a force majeure situation arises that is of such a nature that further commitment from Expedition For Trucks to the agreement cannot reasonably be required. Expedition For Trucks reserves the right to cancel the trip. This includes at least abnormal unforeseen circumstances such as war or armed conflict, a concrete threat of terrorism for the location/locations that are part of the trip, natural disasters, shortages, general strikes, the absence for any reason of the trip leaders or a negative travel advisory issued by the Ministry of Foreign Affairs for (a part of) the trip destination, as well as finding (potential) participants incapable or if there is no longer harmony between (potential) participants and Expedition For Trucks before the start of the trip. In case of cancellation of the trip by Expedition For Trucks, the amount already paid by the participant(s) for the trip will be refunded. The premium for the cancellation insurance, visa-related costs, and any other costs already incurred will never be refunded.
    14.2 If the cause of the cancellation can be attributed to a participant, any resulting damages will be at the expense of that participant. If the cause of the cancellation can neither be attributed to the participant(s) nor to Expedition For Trucks, each party will bear its own damages.|
    14.3 If any of the situations mentioned in paragraph 1 of this article occur during the trip, a claim for reimbursement is only possible for the unused portion of the trip and only to the extent that Expedition For Trucks saves costs due to that cancellation.
    14.4 Expedition For Trucks reserves the right to cancel the trip up to six weeks prior to departure if the number of registered vehicles is less than 10, excluding the vehicles of the trip leaders and trainee trip leaders.
    14.5 Unforeseen local circumstances and the adventurous nature of the trips offered by Expedition For Trucks may necessitate adjustments to the travel program and/or route even during the trip. This may also apply in cases of force majeure such as political circumstances, which include but are not limited to negative travel advice from the Ministry of Foreign Affairs, war, political unrest, scarcity, illness, natural disasters, weather conditions, road diversions, roadblocks, strikes, etc. The management and the trip leaders will ensure that the original character of the trip is preserved as much as possible.
    14.6 If the changes are known prior to the start of the trip, the traveller will be informed. During the trip, any changes will be communicated to the participants by the tour guide.
  1. FORCE MAJEURE
    15.1 Expedition For Trucks is obliged to execute the agreement in accordance with the expectations that the participant(s) could reasonably have regarding the individual guided adventurous overland trip based on the agreement. Expectations can only be met in accordance with the designation and explanation of matters during the ‘inspiring presentation day,’ ‘preparation days,’ and as described in ‘travel information and travel regulations’ and the listing of ‘inclusive and exclusive.’ The assessment should also take into account the adventurous nature of the trip, the local conditions, customs, practices, and limitations that the destination and the nature of the trip may entail.
    15.2 If the Expedition For Trucks trip does not proceed in accordance with the expectations referred to in paragraph 1, the participant is obliged to report this as soon as possible to the trip leader.
    15.3 Expedition For Trucks is not liable to the participant for any failure to comply with the agreement if that failure is the result of force majeure.
    15.4 In addition to Article 6:75 of the Civil Code, a situation of force majeure is considered any shortcoming that cannot be attributed to Expedition For Trucks, provided it is not due to its fault, nor falls under the law, legal act, or prevailing opinion in traffic, and does not grant the participant the right to terminate the agreement or to any (damages) compensation.
    15.5 The following situations are at any rate considered as force majeure as referred to in Article 15.4: a shortcoming or force majeure of a supplier involved in the trip, illness of the trip leader, traffic disruptions, poor condition of roads and signage, non-delivery of necessary materials by third parties, war, natural disasters, scarcity, general strikes, the absence for any reason of the trip leaders, or an adverse travel advisory issued by the Ministry of Foreign Affairs for (part of) the destination of the trip.
    15.6 The participant will be informed as soon as possible by telephone, and if possible, also in writing, by Expedition For Trucks of all details that prevent them from fulfilling their obligations under the agreement. The parties will consult each other regarding the measures that need to be taken to mitigate the effects of the force majeure as much as possible and to ensure the execution of the agreement.
    15.7 If a force majeure situation as referred to in art. 15.4 has lasted more than 30 days, the parties have the right to terminate the agreement with immediate effect, without the other party having any right to compensation.
  1. LIABILITY
    16.1 Expedition For Trucks is never liable for damages caused by engaged suppliers or other third parties. In particular, Expedition For Trucks is not liable for damages to, loss, or theft of items and/or goods belonging to participants in an Expedition For Trucks trip, nor for damages or destruction to or from the participating vehicles and any associated items and/or goods within it.
    16.2 When Expedition For Trucks fails to fulfil one or more of its obligations under the agreement, it is only liable to the participant for direct damages resulting therefrom, taking into account the provisions in this article. Liability for indirect or consequential damages, such as lost revenue or profit, interest or delay damages, missed savings, or reputational damage is excluded.
    16.3 The liability of Expedition For Trucks for damages other than those caused by the death or injury of the traveller is, in all cases, limited to a maximum of one time the travel sum.
    16.4 Insofar as the damage consists of loss of travel enjoyment, the maximum (damage) compensation is one times the travel sum for the respective participant in the trip.
    16.5 Expedition For Trucks is not liable for damages resulting from:
    – Deficiencies in the execution of the travel agreement due to circumstances attributable to the traveller, including damages resulting from the traveller’s health condition and/or the condition of the travel vehicle.
    – Influence and actions of third parties not involved in the agreement.
    – Circumstances that are not due to the fault of Expedition For Trucks and/or cannot reasonably be attributed to Expedition For Trucks under the law or the standards prevailing in social traffic.
    – The shortcoming in the execution is attributable to an event that Expedition For Trucks, the travel guide, or anyone whose assistance he relied on for the execution of the trip, could not foresee or remedy despite all possible diligence.
    – The shortcoming in the execution is due to force majeure as referred to in paragraph 16.5 of this article.
    – Force majeure situations include natural disasters, wars, political unrest, strikes, changes in travel itineraries.
    – Theft, loss, damage to property.
    – Illness and accidents of the traveller.
    – Mistakes made by airlines, ferry companies, etc.
    16.6 Force majeure is understood to mean abnormal and unforeseen circumstances that are independent of the will of the party invoking it and whose consequences could not be avoided despite precautionary measures.
    16.7 Expedition For Trucks accepts no liability for damages covered by travel and/or cancellation insurance.
    16.8 In the event that Expedition For Trucks can be held liable for loss of travel enjoyment, or for damages suffered by the traveller in the exercise of their profession or business, the compensation shall never exceed a maximum of once the travel sum minus the incurred costs. Liability for damages incurred in force majeure situations (see also Article 16.5) and other causes not attributable to Expedition For Trucks is excluded, such as damages due to poor or disappointing conditions of roads, a different expectation than what is offered, the inability to find attractions, whether or not included in the itinerary, or not bringing personal travel guides and maps, the inability to locate the designated waypoints according to the itinerary, with the help of navigation systems or due to insufficient knowledge of their operation, and signage, of camping, camper and/or overnight places, and the associated facilities, or the lack thereof.
  1. RISK OF THE PARTICIPANT
    17.1 The participant travels the entire journey with their own vehicle and at their own risk and peril. Expedition For Trucks can never be held liable for the chosen and actually travelled route, the condition of the roads and paths, the driving conditions, and the driving skills of each individual participant.
    17.2 The participant participates in traffic, drives, and acts entirely at their own risk. The participant shall not hold Expedition For Trucks liable in any way for damages resulting from accidents in which the participant is involved during a trip from Expedition For Trucks, nor for damages to or in the travel vehicle caused by driving on (lesser) quality roads and/or paths.
    17.3 Participants in trips organized by Expedition For Trucks are in sufficient physical and mental condition to undertake the journey and will not hold the organization of this trip liable for damages or accidents resulting from insufficient physical or mental health.
    17.4 By participating in a trip with Expedition For Trucks, each participant automatically agrees, without a written request prior to the start of the trip, that Expedition For Trucks and/or its direct client may use all photo and film material created by Expedition For Trucks and/or its direct client during the trip, free of any rights of the participant(s) and without hindrance for publication in any form. If journalists, reporters, and/or film crews from third parties join the trip for a few days, they will ask beforehand if there are participants who do not wish to be filmed or interviewed.
  1. DISPUTES
    18.1. Dutch law applies exclusively to every offer, expression of a trip, quotation, and agreement between the (potential) participant and Expedition For Trucks.
    18.2 All (alleged) claims not reported to Expedition For Trucks will expire one year after the conclusion of the group trip from which these (alleged) rights arise (or, if the trip did not take place, one year after the original departure date).
  1. APPLICABILITY – FINAL PROVISION
    19.1 These General Terms and Conditions apply to all offers, quotations, and agreements related to all Expedition For Trucks trips, as well as all related (legal) actions by Expedition For Trucks and participants. The General Terms and Conditions also apply to all (future) agreements between the parties.
    19.2 If one or more provisions in these General Terms and Conditions are null and void or are declared invalid, the remaining provisions will remain fully effective. In that case, the parties will enter into negotiations to reach agreement on one or more alternative provisions that closely approximate the original provision. The invalidity of one or more clauses can never lead to claims by one party against the other party.
    19.3 If one or more provisions in these General Terms and Conditions conflict with the provisions in the agreement, the provisions in the agreement shall prevail.
    19.4 These General Terms and Conditions are not only stipulated for Expedition For Trucks, but also for the directors, employees, assistants/third parties engaged, interns, volunteers, and (voluntary) travel companions, as if they were stipulated for themselves.
    19.5 Each registrant declares, upon registration for the trip, to agree to this regulation. If a registrant does not agree with this regulation, they must communicate this in writing to Expedition For Trucks within two weeks of receiving the registration form from Expedition For Trucks. The registration will then be void. No cancellation fees are due.
    19.6 Obvious errors and mistakes in the publications do not bind Expedition For Trucks.
